These Terms of Service ("Terms") govern your use of the Malketing website (https://malketing.com) and the software, applications, and services provided by Malketing (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the Service.

1. Description of Service

Malketing is a Customer Relationship Management (CRM) and WhatsApp Marketing platform designed to help businesses manage customer communications. Our services include, but are not limited to:

  • Integration with WhatsApp Business Cloud API.
  • Team inbox management.
  • Automated messaging and broadcasting.
  • AI-powered assistance (Kamal AI).

2. Account Registration

To access the Service, you must register for an account using your Facebook credentials or email. You agree to:

  • Provide accurate, current, and complete information.
  • Maintain the security of your password and account access.
  • Accept responsibility for all activities that occur under your account.

3. WhatsApp Business Platform Compliance

Malketing is a Tech Provider integrating with the official WhatsApp Business API. By using our Service, you explicitly agree to comply with:

  • WhatsApp Business Messaging Policy.
  • WhatsApp Commerce Policy.
  • Meta Platform Terms.

Important Restrictions:

  • You strictly agree NOT to use Malketing for sending unsolicited messages (SPAM).
  • You must obtain opt-in consent from your customers before messaging them.
  • We reserve the right to suspend or terminate your account immediately if we detect violation of WhatsApp policies or if your WhatsApp Business Account (WABA) is banned by Meta. Malketing is not liable for any account bans imposed by Meta.

4. Use of AI Features (Kamal AI)

Our Service includes Artificial Intelligence features ("Kamal AI") powered by third-party LLMs (e.g., Google Gemini).

  • Accuracy: AI-generated responses may not always be accurate, complete, or up-to-date. You should verify critical information before sending it to customers.
  • Liability: Malketing is not responsible for any errors, hallucinations, or offensive content generated by the AI.
  • Data Usage: Your inputs to the AI may be processed by third-party AI providers to generate responses, subject to our Privacy Policy.

5. Subscription and Payments

  • Fees: Some features of the Service are paid. You agree to pay all applicable fees as described on our pricing page.
  • Billing: Subscription fees are billed in advance on a monthly or annual basis.
  • Refunds: All payments are non-refundable, except as required by applicable law.
  • WhatsApp Conversation Charges: You are responsible for paying any conversation charges levied directly by Meta/WhatsApp for the messages you send.

6. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of any local, state, national, or international law.
  • Harass, threaten, or defraud other users.
  • Reverse engineer, decompile, or attempt to extract the source code of the software.
  • Interfere with the operation of the Service (e.g., uploading viruses or overloading servers).

7. Intellectual Property

The Service, including its code, design, and "Malketing" branding, is the property of Malketing and is protected by copyright and intellectual property laws. You retain ownership of the customer data you upload to the Service.

8. Limitation of Liability

To the fullest extent permitted by law, Malketing shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use the Service.
  • Any conduct or content of any third party on the Service.
  • Any suspension or ban of your WhatsApp account by Meta.

9. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Indonesia, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify you of any material changes by posting the new Terms on this page.
